Overview

These Terms of Service (‘Terms’) govern your use of the BookOfYou website at bookofyou.com.au and our personalised book creation service (‘Service’). By accessing or using the Service, you agree to be bound by these Terms. If you do not agree, please do not use the Service. These Terms are governed by the laws of New South Wales, Australia.

Service Description

BookOfYou is a personalised book creation service. You provide personal context (names, relationship details, memories, and optional photos), and our AI-powered system generates a unique book of original content including story chapters and a custom cover illustration. You may purchase as a digital PDF, a physical printed book (paperback or hardcover), or both. Physical books are printed by Lulu and shipped within Australia. The Service is currently available to customers in Australia only.

AI-Generated Content Disclaimer

Book content is generated by artificial intelligence (Google Gemini). While we design our prompts and systems to produce high-quality, personalised output:

  • Content quality and tone may vary.
  • Generated text may not perfectly match your expectations.
  • AI cover illustrations are artistic interpretations and may not precisely replicate uploaded photos.
  • Content may occasionally contain minor imperfections.

Each book is unique. Two orders with identical inputs may produce different results. We recommend reviewing your preview carefully before purchasing.

Acceptable Use

  • Do not upload content or photos you do not have permission to use.
  • Do not submit unlawful, abusive, or harmful content.
  • Do not use the Service to generate defamatory, discriminatory, or rights-infringing content.
  • Do not resell, redistribute, or commercially exploit generated content without our prior written consent.
  • Do not attempt to disrupt the Service (abuse rate limits, scrape, or attack infrastructure).

We reserve the right to refuse service or cancel orders if these conditions are violated.

Account and Authentication

You may create an account to track orders and access your books. You are responsible for maintaining the confidentiality of your credentials and for all activity that occurs under your account.

Payments and Pricing

Payments are processed through Stripe Checkout. All prices are listed in Australian dollars (AUD) and include GST where applicable. Physical book prices include standard shipping within Australia. Express shipping is available at an additional surcharge. Digital PDF orders are delivered electronically and have no shipping cost. We reserve the right to change prices at any time. Price changes do not affect orders already placed and paid for.

Refund Policy

BookOfYou creates personalised, made-to-order products. Each book contains AI-generated content unique to your specific order. Because of this, our refund policy reflects the personalised nature of our products.

Digital PDF Orders

Digital PDF orders are non-refundable once the download link has been delivered. We provide a free preview before purchase so you can review the generated content before committing to an order.

If you experience a genuine technical delivery failure (such as an expired or broken download link, or a corrupted PDF file), please contact us. We will provide a replacement download link or remedy the issue at no additional cost.

Physical Book Orders — Eligible for Refund or Replacement

  • The book arrives damaged or with significant print defects.
  • The book is lost in transit (where tracking confirms non-delivery).
  • The printed book materially differs from the digital preview (e.g., missing pages, corrupted printing).

Physical Book Orders — Not Eligible for Refund

  • Change of mind after purchase.
  • Dissatisfaction with AI-generated content, tone, or style (this is a personalised product).
  • Minor variations in colour between screen display and print output (this is normal for print-on-demand).
  • Incorrect shipping address provided by the customer.

How to Request a Refund or Replacement

  • Email support@bookofyou.com.au.
  • Include your order email address and any relevant order details.
  • For damaged or defective items, include clear photos of the issue.

We aim to respond to refund requests within 5 business days.

Australian Consumer Law

Nothing in this refund policy excludes, restricts, or modifies any consumer guarantee under the Australian Consumer Law (Schedule 2 of the Competition and Consumer Act 2010) that cannot be excluded by law. Consumer guarantees on acceptable quality, fitness for purpose, and matching description apply to all goods, including personalised products. However, goods made to the consumer's specifications have a specific exemption from the right to reject for failure to match the consumer's subjective preferences about the AI-generated content, tone, or style, provided the goods match the specifications you provided during order creation.

Intellectual Property

You retain ownership of the content you provide to us. We grant you a personal, non-exclusive, non-transferable licence to use the generated book content for personal, non-commercial purposes. You may share your book as a personal gift. You may not commercially reproduce, distribute, or resell generated content.

The BookOfYou brand, logo, website design, and underlying technology remain our intellectual property. You are responsible for ensuring that your inputs do not infringe third-party rights.

Limitation of Liability

To the maximum extent permitted by Australian law, BookOfYou’s total liability arising out of or in connection with these Terms or the Service is limited to the amount you paid for the specific order giving rise to the claim. We are not liable for indirect, incidental, special, consequential, or punitive damages. We are not liable for delays or failures resulting from causes beyond our reasonable control, including internet outages, third-party service failures, or delivery delays.

Nothing in these Terms excludes or limits liability that cannot be excluded under Australian law, including liability under the Australian Consumer Law.

Dispute Resolution

If you have a dispute or complaint, please contact us at support@bookofyou.com.au first. We will endeavour to resolve any dispute informally within 30 days. If the dispute cannot be resolved informally, either party may refer the matter to mediation administered by an accredited mediation provider in Sydney, NSW. If the dispute is not resolved through mediation, it may be submitted to the courts of New South Wales.

Governing Law

These Terms are governed by and construed in accordance with the laws of New South Wales, Australia. You agree to submit to the non-exclusive jurisdiction of the courts of New South Wales.

Modifications

We may modify or discontinue the Service at any time. We may update these Terms from time to time. The updated version will be posted on this page with a revised date. Your continued use of the Service after any changes constitutes acceptance of the updated Terms.

Severability

If any provision of these Terms is found to be invalid or unenforceable, the remaining provisions shall continue in full force and effect.
